Spousal support after a divorce
After a divorce or the end of a registered partnership, an obligation to pay alimony may exist in the Netherlands. That is not an automatic fixed amount. The need for support and financial capacity are assessed. The duration and conditions depend on the applicable rules and your circumstances.

Identify income and needs
Collect information about income, expenses and the financial situation during the relationship. Also note factors that influence work and income, such as care responsibilities. An advisor can assess what data is needed and how it is weighed.
Make it clear which contribution is intended for children and which for an ex-partner. The arrangements may influence each other financially, but are not interchangeable. Therefore, have the entire overview viewed instead of just one monthly amount.
Make agreements or ask the judge
You can make agreements about spousal maintenance, for example as part of the divorce. Ask for an understandable explanation of the amount, the term and the circumstances in which a change is possible. Have your own interests assessed before you sign.
In the event of a dispute, a lawyer can submit a request to the judge. The judge assesses, among other things, need and capacity. Even if you agree, legal control can help to prevent unclear expectations and difficult-to-implement agreements.
When life changes
A changed financial or personal situation may have consequences. Whether adjustment or termination is possible requires an assessment of the agreement and the legal rules. Therefore, do not independently stop a fixed payment based on a suspicion about your ex-partner.
From financial situation to substantiated need
A maintenance request does not start with an arbitrary amount. Visualize the situation during the relationship, current income and necessary expenses. Note circumstances that affect working and earning. This makes it clear which questions an expert must investigate. Indicate which data are still estimates and which can be substantiated with documents.
The options of the other partner must be considered separately. A high level of spending during the marriage does not mean that the same contribution is always feasible after divorce. Obligations for children and other circumstances may be relevant. Request an explanation of the complete financial overview, so that one monthly amount is not assessed separately from the rest of the divorce package.
Apply duration rules carefully
The official rules make a distinction between the period in which alimony has been agreed or determined. There are exceptions. A slogan that always says five years therefore omits important conditions. Collect marriage details, relevant dates and previous decisions before treating a personal end date as set. The text of an agreement can also be important.
Ask which legal regulations apply, whether the agreement deviates from them and what amendment or extension means. This guide does not calculate an individual completion date. This follows from the applicable rules and documents. In an existing case, have the original calculation included, so that it is visible which principles have been used previously and which facts have now actually changed.
Agree on more than just a monthly amount
Discuss payment method, duration, indexing and possible changes. Be aware of conditions that restrict change or seek final settlement. Ask about the meaning before consent. A compromise on home or assets may be related to maintenance. Compare the entire package and explain what risks each part may have for the future.
Anyone who only negotiates the amount may miss conditions that later prove decisive. Make it clear whether an agreement is intended to be temporary, reviewable or permanent. Ask what happens if unexpected changes occur. An apparently simple exchange between assets and maintenance can also raise financial and tax questions that are not apparent from the monthly amount itself.
Hypothetical example: a new relationship
Suppose a paying ex-partner hears that the other has a new relationship. Immediately concluding that payment can stop is too quickly. The precise facts and legal conditions must be investigated. Een bezoek, bericht of gerucht geeft daarop niet automatisch het antwoord. Vraag welke informatie relevant is voor een zorgvuldige beoordeling.
Store your own relevant data lawfully and ask advice about the assessment, instead of choosing risky research methods yourself. Laat een advocaat uitleggen welke overeenkomst of procedure nodig is. Onterecht stoppen kan achterstanden en extra conflict veroorzaken. Here too, doubts about the obligation and the question of how payment should be adjusted are separate steps.
Practical checklist
- Verzamel inkomensgegevens en bestaande overeenkomsten.
- Scheid kindkosten van persoonlijke kosten.
- Vraag uitleg over duur en wijzigingsvoorwaarden.
- Bespreek de gevolgen van belangrijke veranderingen.
- Look up date, text and calculation of the original determination.
- Have the coherence of the entire separation package assessed.
Frequently asked questions
Does every ex-partner receive alimony?
No. The type of relationship, financial need, capacity and applicable rules are decisive. A personal assessment is needed.
Do unmarried cohabitants have the same legal arrangement?
Legal spousal support after marriage or registered partnership does not automatically apply to cohabitants. Any contractual agreements must be examined separately.
Can I exchange home assets for alimony?
Such a proposal could have legal, financial and tax consequences. Have need, capacity, distribution and conditions assessed together. A simple comparison of amounts does not reveal which future risks or rights are being exchanged.
Does alimony stop with each new relationship of the recipient?
No, a new relationship is not in itself a complete legal assessment. Relevant facts and legal conditions must be investigated. Therefore, do not change an established obligation solely on the basis of a suspicion or statement.
