Understanding parental authority

In the Netherlands, parental authority concerns the responsibility for care, upbringing and important decisions. It is something different from legal parenthood or the daily division of care. Therefore, first check who has authority before making agreements about school, medical care or a move, for example.

Check the current situation

The way in which authority arises depends, among other things, on marriage, registered partnership, recognition and previous decisions. Recognition on or after January 1, 2023 usually automatically creates joint parental authority, but there are exceptions.

An extract from the parental authority register may be useful. However, authority that arises automatically is not always included as a separate registration. So also have birth details, recognition and other relevant documents examined if the outcome is unclear.

Making decisions together after the divorce

If you have joint parental authority, important decisions remain a joint responsibility. This does not automatically mean that the children spend exactly the same amount of time with both parents. The care arrangement and authority must be viewed separately.

Discuss a disagreement as specifically as possible: what decision is necessary, what interests are involved and what information is missing? Record proposals and seek advice when consultations get stuck. Unilateral action can complicate a dispute.

Request or change authority

Some joint applications can be made using a form without a lawyer. A lawyer is required for a disputed request or a request for sole parental authority. The judge assesses the circumstances and the interests of the child; a divorce does not automatically give the right to sole parental authority.

Start with the legal starting point

Map the family situation in chronological order: birth, marriage or partnership, recognition and judicial decisions. Note whether a guardian or other person holding parental authority is involved. Facts and documents are more important than the name parents give to their collaboration. An agreement about daily life does not automatically answer how the legal position of authority arose.

A parent can provide a lot of daily care without having sole authority. Conversely, little contact does not automatically mean that authority has ended. Create separate questionnaires for authority, residence and contact. This way you prevent a discussion about one topic from unknowingly becoming the answer to another topic. Also tell an advisor which previous procedure took place and with what result.

Make the important decision concrete

Which school, treatment or move is ahead? What consequences does the proposal have for the child and for the other parent? Gather relevant information and alternatives. As a result, consultation is not only about the word consent, but also about the decision that actually needs to be made. Ask what information the other person holding parental authority needs in order to respond substantively.

School, travel time and care arrangements may be important in a relocation plan. Do not treat a proposal as a fait accompli when joint decision-making is necessary. Ask in advance what permission is required and what route there is in the event of disagreement before you enter into any obligations. A contract or registration can create practical pressure, but does not automatically replace the necessary legal assessment.

Hypothetical example: recognized but authority unclear

Suppose a father recognized the child before 2023 and both parents thought that this automatically created joint parental authority. A school question reveals uncertainty. The first step is to check documents, not immediately assume that the school or the other parent is wrong. Collect the recognition data and any subsequent agreements or court decisions that may change the situation.

If joint parental authority is not available, investigate which application route is open. If agreed, a form route can be appropriate when the conditions are met. In the event of a dispute or special situation, a lawyer will assess the necessary procedure. The example shows that a shared expectation is not proof of the legal position, even if both parents have performed practical tasks for years.

Choose the correct purpose of a request

Do you want to determine the current position, apply for joint parental authority, have one decision made or change parental authority? Those are different goals. A form for one route may be unsuitable for another question. Therefore, describe specifically what is missing and what result is needed. Ask the lawyer which facts make a legal difference and which supporting documents apply.

Asking for sole parental authority is a different assessment than a disagreement about one important decision in joint parental authority. Discuss consequences and alternatives. A divorce or difficult communication does not provide an automatic outcome. An extensive file of accusations is of little help if it is not clear how the problem affects the child and why a particular legal solution is required.

Practical checklist

  • Collect birth certificate, recognition data and previous statements.
  • Check what an extract from the parental authority register shows.
  • Describe the decision that requires consultation.
  • Ask which application procedure and legal assistance are appropriate.
  • Create a timeline of birth, recognition and previous procedures.
  • Separate the question of parental authority from residence and contact.

Frequently asked questions

Does the parent with whom the child lives receive sole parental authority?

No. The primary residence does not automatically determine who has authority. Joint parental authority can also exist when the child mainly lives with one parent.

Does recognition always provide authority?

No. The date of recognition and legal exceptions are important. Recognition before 2023 does not in itself provide automatic joint parental authority.

Can we change authority with our own agreement?

Don't assume that. Daily agreements do not automatically change the legal parental authority position. Have it checked which registration, application or judicial decision is required for the intended result and which existing decision still applies.

Do I need a lawyer for every parental authority issue?

No. Some joint applications can be submitted without a lawyer using a form. This is mandatory for a disputed request and certain other procedures. Use the official procedure description and have special circumstances checked.
