Divorce: from first decision to agreements
A divorce affects your family, home and finances at the same time. In the Netherlands, a marriage is dissolved by the court and you need a lawyer for the request. Start with an overview: what has already been agreed, what do you disagree on and what requires immediate attention?

Map out your situation
Collect your marriage details, any conditions and an overview of assets, debts and income. Make a note of which home you use and what joint obligations you have. This way, an advisor can think along with you in a targeted manner.
Do you have minor children? Then discuss the care, important decisions and their costs. The parenting plan is an important document for this. Make it clear which agreements are provisional and which you want to commit for a longer period of time.
Choose appropriate support
If you agree, a joint request with one lawyer may be possible. If there are conflicting interests, each person may need their own lawyer. Ask in advance who will be assisted and what the assignment entails.
A mediator can guide consultations when you can participate safely and voluntarily. Discuss separately which legal checks and formal steps are still needed. The mediator does not automatically replace the lawyer when filing the divorce.
When something can't wait
Is clarity urgently needed during the divorce about the home, children or a contribution? Ask a lawyer which temporary agreements or interim measures are appropriate. Have existing payments and obligations assessed before you change them unilaterally.
Agree, partially agree or disagree
If you agree on everything, then you can focus on checking and formalizing the package. Ask whether the financial information is complete and whether everyone understands which rights are recorded. A quick signature is worth little if the agreements later prove to be unenforceable. Therefore, check not only whether a proposal sounds attractive, but also who must do something and what conditions apply.
In the case of partial agreement, not every topic needs to be discussed again. Keep three columns: agreement, still to sort out and dispute. Perhaps the division of care is clear, but the home is not yet. Have it explained which parts can be recorded jointly and where separate advice or a decision is required. Do not make a final commitment about a part for which important information is still missing.
Arranging money and housing in a feasible manner
Make two household budgets for the expected situation after the divorce. Include housing, transportation, insurance and child costs. These are preliminary overviews, not alimony calculations. They do show whether a desired housing solution practically fits the available resources. Note which amounts are fixed and which are still estimates, so that an advisor does not mistake uncertainties for established facts.
Check who is the contracting party. Agreeing that one partner will pay the mortgage from now on does not automatically mean that the bank releases the other from liability. Ownership, debt and daily use are different topics. Ask what consent and documents are required before a final distribution. A solution must not only be right between you, but also towards the organizations involved in implementation.
Hypothetical example: the takeover of the house is still uncertain
Suppose two spouses want to divorce, but the bank still has to assess whether one can take over the home. They already have agreements about the children. The missing bank decision is then its own implementation point; it does not automatically mean that all other agreements are unusable. Indicate what is certain and what part can only be finalized after further research.
A sentence such as the house goes to one partner leaves open questions: at what value, under what financing conditions and what happens in the event of rejection? Let such scenarios be worked out. The example does not provide a standard solution: ownership relationship, prenuptial agreement and financing determine which options should be explored. In addition, discuss how ongoing costs will be borne as long as the final solution is not yet feasible.
After the ruling: who will implement the agreements?
Ask who takes care of the registration of the divorce and how you will receive confirmation. Keep decision and final agreements together. A ruling may contain agreements, but implementation often requires payments, transfers or contact with other organizations. Make it clear when a document is a draft and when the legally necessary next step has actually been completed.
Create a task list with responsible person, required information and checkpoint. Consider pensions, joint accounts, housing contracts and the changed family situation at the authorities involved. If in doubt, do not set an arbitrary date: have the applicable legal or contractual deadline confirmed. A clear implementation list prevents each person from assuming that the other or the lawyer has already taken on a practical task.
Practical checklist
- Collect prenuptial agreements and financial documents.
- Write down which child agreements already exist.
- Write down urgent points and your most important questions.
- Ask about method, costs and possible legal assistance.
- Make a budget for each household after the divorce.
- Check who monitors registration and execution.
Frequently asked questions
Can I divorce if my partner does not cooperate?
You can only submit a request. The handling and additional disputes depend on your circumstances. Discuss the options with a lawyer.
Were we divorced immediately after the verdict?
The formal settlement also includes registration with the civil registry. Let your lawyer explain what steps are necessary after the verdict.
Does everything have to be arranged before I speak to a lawyer?
No. Please include the open questions. An initial overview of the relationship, children, home and finances helps determine priorities. Indicate what information is missing. The lawyer can explain what must be investigated first and which choices depend on this.
Does a housing agreement also solve all financial questions?
Not by itself. A housing agreement may be related to distribution, financing, maintenance and other entitlements. Have the entire package assessed and ask what permission from a bank or use of a notary is required for implementation.
