Interim measures during divorce: what cannot wait?

Finalising a divorce can take time while everyday life continues. In the Netherlands, spouses can make temporary arrangements and a lawyer can request interim measures where necessary. These are temporary court decisions within the appropriate procedure. Not every urgent wish automatically fits the same route; first define the specific problem.

Distinguish the temporary question from the final dispute

Do you need to establish who uses the home now, how children will be cared for or how essential expenses will be met? Describe the current situation and the next practical problems. A temporary question concerns the period that needs to be bridged. That differs from finally deciding ownership or dividing the entire marital estate.

Record your proposed temporary solution and how it works for both households and the children. Also identify the final questions still outstanding. A focused interim arrangement can help maintain an overview without pretending that it fixes every right permanently. Ask the lawyer to explain which subjects the procedure can actually cover.

Can a temporary agreement be made sufficiently clear?

Where safe discussions are possible, parties can make temporary arrangements. Write down their scope, who performs each task or payment and how further changes will be discussed. Avoid ambiguity about whether temporary accommodation is intended as a permanent waiver. Ask for an explanation of the legal effect of the wording.

An arrangement works only if it is sufficiently precise and realistic. Saying that everyone pays what they can offers little certainty about fixed expenses. Ask which information is needed to agree responsibly on an amount or task. Also discuss the next step if the agreement is not followed or circumstances change quickly.

Temporary occupation of the home

A request concerning temporary occupation is not automatically a request to transfer ownership. Collect information about current occupation, contracts, available alternatives and children's relevant interests. Explain factually why a practical decision is needed. A title deed alone does not answer every question about temporary circumstances during divorce proceedings.

Keep housing expenses visible as a separate issue. Who remains in the home and who makes each payment do not necessarily have the same answer without further assessment. Ask how temporary arrangements relate to the bank, landlord and final division. Do not change locks or access solely on your own assumptions about the answer to a legal question.

If the home is rented, also assess who continues the tenancy after divorce. A decision on temporary use does not itself settle the final tenancy position.

Children and necessary contributions

Describe existing care, school and daily routines. A temporary proposal must show practically how the child will be cared for in the coming period and how information will be shared. Explain which parts already work and where the problem lies. Do not confuse an emergency solution with a complete future parenting arrangement.

Current income and expenses matter for financial questions. Also collect existing agreements and payments so that what is already happening is visible. A general reference to the usual standard of living does not answer every calculation question. Let the adviser identify the information needed and how a temporary contribution can legally be requested or recorded.

Prepare for the lawyer and the procedure

Explain whether divorce proceedings have already started and provide earlier documents. Timing and the selected route may bring conditions and further steps. Have the lawyer confirm applicable deadlines; do not use a general internet date as personal procedural advice. Pass on documents promptly so that any need for a response can be assessed in time.

Ask which decision is being requested, what supporting evidence is needed and who supplies each piece of information. The other party may take a different position. Proceedings do not guarantee adoption of your proposal. Therefore also discuss realistic alternatives and your most important practical objective during the intervening period.

Hypothetical example: divorce is pending and joint occupation is unworkable

Suppose spouses still live together and clash seriously every day about use of the rooms, while division of the owned home remains unresolved. A lawyer can investigate which temporary arrangement and evidence are appropriate. Final ownership and temporary occupation must remain clearly distinguishable.

The example does not give automatic priority to the owner, the parent providing more care days or whoever asks first. Facts and interests require assessment. If the situation also involves threats or immediate danger, urgent safety belongs with appropriate support services. Waiting for a legal arrangement is then not the only necessary step.

Read and monitor the temporary decision

Read with your lawyer exactly what the decision provides and which issues remain unsettled. Ask for what period or until which procedural stage the measure applies. Record the payments and practical actions that follow. Its temporary nature does not make it optional; Dutch government information explains that parties must comply with it.

Discuss changes, uncertainty or implementation problems promptly. A new preference is not automatically a reason to disregard the decision. Have the available variation or next steps assessed and ask how the interim situation connects with the main proceedings. Keep the decision beside existing agreements so the arrangement governing each subject remains clear.

Practical checklist

  • Describe the current problem and why waiting is difficult.
  • Collect existing applications, agreements and decisions.
  • Prepare a concrete temporary proposal and alternatives.
  • Organise housing, child-related and financial information separately.
  • Ask about the applicable procedure and its requirements.
  • Check implementation and how long the decision applies.

Frequently asked questions

Can I request interim measures during divorce myself?

In this family-law procedure a lawyer applies to the court. Do not confuse it with administrative proceedings using a similar term but different requirements.

Does this finally divide the home?

A temporary decision about occupation is not automatically a division of ownership. Ask which rights remain open and how the final settlement is handled.

Can I discuss this before applying for divorce?

Yes, discuss the urgency with a lawyer. Conditions may apply to the correct timing and further steps, and need explanation for your situation.

What if my spouse does not comply?

Keep the decision and factual information about non-compliance. Ask your lawyer which enforcement or next step fits. Do not assume on your own that obligations have ended.
